April 28, 2006 was the two year anniversary of my motorcycle vs. Ford Explorer wreck. Those that don't know the story should look at the pictures of the wreck and the exchange between the horrible lawyer, Ms Liz Borg of McAdory Borg, I shouldn't have hired, the Alabama State Bar and me. Since two years was the statute of limitations for a lawsuit against Ellen Ingram, I guess now is a good of time as any to make all the facts known.
To make it short, I hired Liz Borg to represent me in a lawsuit against Ellen Ingram. Ms. Borg decided to wait until less than three months until the statute of limitations was up, before decided to not take the case to court. This of course left me without a lawyer and a very old accident.
I decided to write a complaint to the Alabama State Bar because I believed that Ms. Borg had failed to comply with their Rules of Professional conduct. When I receive a decent response from the state bar I will add it to the article.
I would advise anyone looking for a lawyer in the Auburn / Opelika, Alabama area to steer clear of Liz Borg and McAdory Borg Law Firm.

Since you're not going to say it yourself...
You've already recieved a "decent" response - the bar has denied your claim 3 times now. Ms. Borg is by far the best personal injury lawyer in all of Lee County. Then again, even Jesus Christ himself can't make some cases work, and yours is one of them.
You also fail to note that your "contract for employment" doesn't require that she do anything for you. The contract merely states that she will recieve 45% of anything she wins in your case. If she wins nothing, then you pay nothing. Its called a contengency case.
For your information, your file on your case is over 4 inches thick. 80% of that is progress Ms. Borg has made on your case. Have you come to pick up your file since you seem to think you have a case? No, of course not. You have the right at any time to come and get your case file and take it to another lawyer. Instead, you file a baseless complaint which you've now lost 3 times.
Also, your contract is signed by two "friends" of yours. You didn't even agree to the contract for your own case. You cannot have any claim against her for breach of contract or the Bar Association equivilent if you never signed the contract. In fact, according to that contract, any action against Ms. Borg would have to be filed under one of their names, as you have no rights at all.
Again, as she has said in her (written, not verbal) response, you have failed to come get your file, which would be essential if you plan to continue this case. This is a clear sign that you have never had any intention of taking this case to trial. Furthermore, if you had consulted another lawyer in this matter, they, too, would tell you you don't have sufficient evidence, and for good reason - you don't. The accident report (filled out by a Lee County Sherriff's Deputy, who does this for a living) for your wreck lists YOU as the driver at fault, the one who caused the accident. Even if that's not true, if the report says it is, a Jury will believe an officer's accident report over any amount of your testimony in existance.
Yes, she did spend "time and money" in your case. Over 280 dollars in office supplies alone, to be exact. That's not to mention the 200+ hours of billable work. Had she taken this case on an hourly basis at her normal rate at that point, it would've cost you $39,000 of attorney fees and over $2,000 of court costs. That alone is more than you would've won in any trial or settlement in this county. The fact that she took your case on a contengency actually saved you a $41,000 bill for an unwinnable case. You should be geatful.
You also fail to mention that you were reffered to Dr. Lyle at the Houghston Clinic by Ms. Borg. Had she never mentioned it you might still actually be injored (which you're not, I assume, otherwise you might still be trying to persue the case instead of the lawyer.) In fact, she called in several favors to convince them to see you for free, in exchange for paying $2,000 for a deposition in your case - twice.
Also, the response to your Bar Complaint in which she included "things you'd consider confidential" was confidential. Until a bar complaint is settled, none of the paperwork in that complaint is released to the public. If you hadn't lost your complaint (again, three times now) none of it would still be public. Putting it on this web site clearly shows you don't mind it being public in the first place.
Officer Moody has been an officer for over 23 years and has never once had any complaint filed against him which stood up in court. Ms. Borg has also been an attorney for over 16 years and she, too, has never had a bar complaint stand against her. Also, while she was a judge (for a mere 2 years) she cleared a backlog of over 1,100 cases left by the previous judge whose term she finished (an 11 year backlog) and out of over 4,000 cases, her ruling was only appealed once, and even then her ruling was upheld upon appeal. She has the cleanest record as a Judge in the entire history of the state of Alabama. In addition, in 28 seperate cases while she was a judge where she found defendants guilty, the defendants themselves later told her they thought her sentance was fair and appropriate for the crime they committed (ranging from bad checks to, in once case, a tripple grand theft auto.)
In closing, let me say that I know all this as a fact because I have personally bore whitness to this entire or deal. Lis Borg is my mom. I'm Austin McAdory, her son. And I invite everyone who reads this to fact check any and all of what I've said.
Lastly, I would highly advise you to take down what you've said here, since multiple instances of what you've said here violate numerous slander laws. What my mom, Ms. Borg, did was what any lawyer with a head on his or her shoulders would do. She tried to make a case where there wasn't a case, and upon failing gave you numerous ways to continue your case if you wanted to do so. Badmouthing a lawyer for putting over $50,000 total into a case just because there's not a case there shows only one thing. it shows that you are, as my mom did in fact say over the telephone, an ungreatful person. I can safely say that after that phone call I agree, and after reading this, my view that you are a snotty ungreatful poor loser is only further solidified.
Let's see, the 23 year veteran police officer is wrong, the independent witnesses who don't know you and have no reason to lie are wrong, the bar association is wrong, the lawyer is wrong........guess you are the only one that is right? Well, don't keep us guessing, post the response from the bar association.

The police officer did fail to do his job when he didn't even both to check if her insurance was up to date, or to check if her taillights were working, since that was the only thing I would say to him on the scene of the accident(he never came and took a real statement from me.
I never accused the witnesses of lying. I only know of one witness and his statements pretty much align with what I say of the wreck.
I never said the bar association was wrong. I don't agree with them, but that's why I love living in America, I can disagree with them. And I can use my site to voice my opinion.
